Terms and Conditions

These terms and conditions (the “Terms and Conditions”) govern the use of Generation Mama. Generation Mama is owned and operated by Generation Mama Ltd. This site is an ecommerce website.

By using this site and/or if you order products from us, you agree that you have read these Terms and Conditions and agree to abide by them at all times.

Any reference in these Terms and Conditions to “we”, “us” or “our” is a reference to Generation Mama Ltd. Any reference to “you” or “your” is a reference to any consumer and these references may be used interchangeably.

Generation Mama is an ecommerce website, owned by Generation Mama Ltd.

We may contact you by any of the contact details which you provide to us, generally email or telephone however if you have contacted us via social media then we may contact you this way too.


2. HOW TO PLACE AN ORDER


2.1 How to place an order

You can place an order on Generation Mama if you have an account with us or not (guest checkout).

Once you have decided which products you would like to order, firstly add them to your basket. When you are satisfied that you have all the products in your basket which you would like to order, click the checkout button in the top right corner of the screen. This shows your basket, items included and total order value (this will also contain customisation information if relevant).

By proceeding to checkout with your order, you agree to the Terms and Conditions listed on the website and within this document.

When you confirm your order, we will take payment using your chosen payment method.

You will receive a confirmation email containing your order details, including order number. It is your responsibility to check that all order details, including the recipient name and address are correct prior to placing your order.

2.2 When we accept your order

When you place your order, and we send an email to confirm your order, we have accepted your order as placed.

You will be issued with an order number at the same time as we send your confirmation email (and this will be included on the email).

2.3 If we cannot accept your order

There may be occasions in which we cannot accept your order. For example, but not limited to, there being an incorrect duplication of orders, suspected fraudulent activity or a product ordered is out of stock. In this instance we will issue a full refund for your order.

2.4 Ordering multiple products

When multiple products are ordered to the same address, we will endeavour wherever possible to include in one delivery unless there is a valid reason why this is not possible. Please note however that we cannot guarantee that products ordered at the same time will be included in the same delivery.

2.5 Age restrictions

You must be 18 years old or over to use and place orders on the Generation Mama website.


3. OUR PRODUCTS


The products sold on Generation Mama are predominantly shipped in the UK, although this may be from multiple locations.

3.1 Product variations

We cannot guarantee that products will not vary slightly from their images on the website. While we do our best to ensure that the images reflect the products as accurately as possible, some aspects (i.e. colours) may vary due to the way that differing devices display them. There also may be variations to the type of packaging used to that displayed on the website.


4. PRICE AND PAYMENT


4.1 Price of product

All prices are listed alongside the product, inclusive of VAT. We take appropriate steps to ensure all prices are correct.

If you suspect that the price is incorrect, please contact the Generation Mama team as soon as possible and we will do our best to rectify.

4.2 Payment methods

You can make payment for your order by credit or debit card. You can also pay via PayPal and any other listed payment methods.

4.3 Offers and discounts

We may occasionally run competitions or promotions with offers or discounts.

If these include a discount code, there is a box in which this can be inputted during the checkout process. This will automatically deduct the specified amount from the total cost of the order.

Please note that offers and discounts are subject to their own Terms as stated, including that they may only apply to specified products.

Generation Mama reserves the right to amend, cancel or extend any offer or discount, competition or promotion at any time, with or without warning. Promotions cannot be applied retrospectively.

There are no cash alternatives to offers and/ or discounts.


5. DELIVERY AND DISPATCH


The item is sent on the dispatch date. This is not the date of delivery.

Delivery costs may be additional to the product cost. We will make you aware of any further delivery costs prior to placing your order.

Please be aware that it is your responsibility to ensure that the recipient name, address and postcode is correct prior to ordering, to avoid any unnecessary delays. If you have requested for the product to be delivered directly to another person, please double-check the address to avoid any errors.

5.1 Delivery costs and options

Delivery costs will be added upon checkout, and all available delivery options will be listed.

5.2 Estimated delivery times

As stated, Generation Mama is not able to guarantee the delivery times of products. Products will be delivered according to the delivery choice selected and, while most products are delivered according to the timeframes specified, please account for any delays by placing your order as soon as possible.

We are not responsible for delays outside of our control such as acts of God, natural disasters, epidemics or pandemics, terrorist attacks, war, threats of war, riots, imposition of sanctions, embargo, or breaking off of diplomatic relations, nuclear, chemical or biological contamination or sonic boom, any laws imposing an export or import restriction, quota or prohibition, or failing to grant necessary licence or consent, collapse of buildings, fire, explosion or accident, industrial action, interruption or failure of utility service). We will inform you of any such situation as soon as possible and take the appropriate steps to minimise any such delay.

If this delay means that the order is no longer required, you may contact us for a refund.

5.3 If the recipient is not at home

If the recipient is not at home, and the product does not fit through the letterbox, we operate a “leave safe” policy. Delivery will be attempted in the first instance to the home address however if there is no answer, then it may be left either with a neighbour or a safe place. If the delivery driver cannot deliver still, then a note will be posted with instructions as to how to obtain the order.

5.4 Passing of property

Generation Mama Ltd will retain ownership of the goods until full payment has been received and funds cleared. The risk in goods will pass to the customer upon delivery.

5.5 Delivery outside of the UK

Currently Generation Mama only operates in the UK.


6. ORDER CHANGES


If you wish to make changes to your order, or any information that you have provided to us (such as delivery address), please make us aware of this as soon as possible. We will do our very best to accommodate any changes however this cannot be guaranteed as it depends on the stage of the order.

We may also make changes to your order to comply with any new laws or regulations. If the change is significant, then we will always make you aware of this prior to order dispatch.


7. REFUNDS AND EXCHANGES


a) Refunds

The Customer shall be deemed to have accepted the goods unless they notify Generation Mama within 7 days of receipt. This does not affect the customer’s statutory rights. If no such action has been taken, Generation Mama shall consider the products being as described, of satisfactory quality and fit for their purpose and may not accept any reject at a later date.

Items can only be returned for a refund if they are unopened, unused and in a re-saleable condition.

Unless the goods are faulty, you will be required to arrange and pay for the cost of returning them to us. Please ensure you obtain a proof of postage when you do so.

If you require a refund we will refund the price paid by you for the goods, but not the additional cost of any premium delivery option that was chosen within fourteen (14) days of receiving your returned goods, provided that you have returned the goods to us within 7 working days of delivery to you or your notifying us of cancellation.

In cases where the return of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund or replacement. We will also refund the delivery charge for sending the item to you and the cost incurred by you for returning the item. The faulty or damaged product must be returned to Generation Mama as soon as possible. Please ensure you obtain proof of postage.

b) Reporting a problem

If you have a problem with a product or our service, please report this as soon as possible quoting your order number to gm@generationmama.co.uk. This should also include your full name and details of the issue.

We will respond to all enquiries at the soonest opportunity and resolve as soon as possible. If the issue is with the product itself, we may ask for you to provide a photograph of the product so that we may raise the issue internally or with our suppliers, or return the product to us.

c) Returns

If you wish to exercise your right to a refund under any circumstances then we will often request that the product is returned to us. We will refund the cost of the product and delivery to you upon received return of the product.


8. INTELLECTUAL PROPERTY


All content made available and published on the Generation Mama site is the property of the site owners. This includes, but is not limited to, images, text, logos, documents, downloadable files and anything else that contributes to the composition of our site.


9. LINKS TO OTHER WEBSITES


Our site contains links to other third party websites. We are not responsible for the content, policies or practices of other websites and we do not endorse their content. It is your responsibility to read the policies, terms and conditions of these websites before using them.


10. CUSTOMER REVIEWS


If you submit a customer review on this website, or any other third party customer review provider, then you agree that you are the sole author of the review, that it is accurate and that you are over 18 years old.

You agree to grant the perpetual, irrevocable, royalty-free, transferable right and licence to use, copy, modify, delete in its entirety, adapt, publish, translate and create derivative works from that review in any medium or technology throughout the world.

We reserve the right to decline publication of reviews or to remove reviews at our discretion. By submitting your email address in connection with your review, you agree that we may use your email address to contact you about your review. We will not pass your details onto any third parties without your consent. We accept no liability for your personal information in relation to reviews you leave on third party websites.

12. UPDATES

These terms may be updated from time to time on the website. We will notify users of changes by email or by a notice on the website.


13. LIABILITY


Generation Mama, and our directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from the use of this site.


14. INDEMNITY


Except where prohibited by law, by using this site you indemnify and hold harmless Generation Mama, and our directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from the use of this site and your violation of these terms and conditions.


15. SEVERABILITY


If at any time the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions without impacting or affecting any of the other contents of the Terms and Conditions. All the other Terms and Conditions will be considered valid.

These Terms and Conditions are governed by the laws of the Country of England.
